Macromedia Flash ';duplicateMovieClip'; question !! How do I set the layer of the new movieclip?(not depth)

I'm making a video and i have a background item which duplicates to various places. However, the original item shows up behind the text, but all the duplicates show up in front of it... There is no sense of layers in flash runtime, layers are an abstraction of depth used inside the flash development tool. I would create an empty movieclip and position it in the layer you're targeting, then add child movies to this empty movie. depth will still be a concern here but should only be relative to that movies child movies. make sense?
